  1. Scope of Application

The following General Terms and Conditions (GTC) apply to all orders placed through our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

For entrepreneurs, these GTC also apply to future business relationships, without us having to refer to them again. If the entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them.

  1. Contracting Party, Conclusion of Contract

The purchase contract is concluded with Pfillo GmbH.

By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded by you accepting the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive another confirmation by e-mail.

  1. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is German. 

We do not store the contract text.

  1. Delivery Conditions

In addition to the stated product prices, shipping costs may also apply. You can find more detailed information on any applicable shipping costs in the offers.

You generally have the option of picking up your order at Pfillo GmbH, Kimplerstraße 340, 47807 Krefeld, Germany, North Rhine-Westphalia during the following business hours: 10:00-16:30.

We do not deliver to packing stations.

  1. Payment

In our shop, the following payment methods are generally available to you:

Prepayment
If you choose the prepayment method, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

Credit Card
By submitting your order, you simultaneously transmit your credit card details to us.
After your legitimation as the rightful cardholder, we will ask your credit card company to initiate the payment transaction immediately after the order. The payment transaction is automatically carried out by the credit card company and your card is debited. 

BillPay Direct Debit
After a successful address and credit check during the order process, by submitting your order, you grant BillPay, the online provider, a SEPA direct debit mandate, and we assign our claim to BillPay. BillPay will inform you of the date of the account debit (so-called pre-notification). By submitting the direct debit mandate, BillPay requests your bank to initiate the payment transaction. The payment transaction is carried out automatically and your account is debited. The account debit takes place before the goods are shipped. For payment processing via BillPay, the GTC and data protection declaration of BillPay apply in addition to our GTC. PayPal, PayPal Express 
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. 
The payment transaction is automatically carried out by PayPal immediately thereafter. Further information can be found during the ordering process. 

PayPal Plus
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal Services. You will be redirected to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you have selected PayPal as the payment method, you must be registered there or register first and legitimize yourself with your access data to be able to pay the invoice amount. The payment transaction is automatically carried out by PayPal immediately after confirmation of the payment instruction. Further information can be found during the ordering process. 

If you have selected credit card as the payment method, you do not need to be registered with PayPal to be able to pay the invoice amount. The payment transaction is carried out immediately after confirmation of the payment instruction and after your legitimation as the rightful cardholder by your credit card company at PayPal's request and your card is debited. Further information can be found during the ordering process. 

If you have selected the payment method direct debit, you do not need to be registered with PayPal to be able to pay the invoice amount. By confirming the payment instruction, you grant PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called pre-notification). By submitting the direct debit mandate immediately after confirming the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited. Further information can be found during the ordering process. 

If you have selected the invoice payment method, you do not need to be registered with PayPal to be able to pay the invoice amount. After a successful address and credit check and placing the order, we assign our claim to PayPal. In this case, you can only make payment to PayPal with debt-discharging effect. For payment processing via PayPal, the GTC and the data protection declaration of PayPal apply in addition to our GTC. Sofort
After submitting your order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have an online banking account activated for participation in Sofort with a PIN/TAN procedure, legitimize yourself accordingly, and confirm the payment instruction to us. Further information can be found during the ordering process. The payment transaction will then be carried out immediately by Sofort and your account will be debited.

Giropay
After placing the order, you will be redirected to your bank's website. To pay the invoice amount via Giropay, you must have an online banking account enabled for Giropay with a PIN/TAN procedure, legitimize yourself accordingly, and confirm the payment instruction to us. Further information can be found during the ordering process. The payment transaction will be carried out immediately thereafter and your account will be debited.

Paydirekt
After placing the order, you will be redirected to the website of the online provider paydirekt. To pay the invoice amount via paydirekt, you must have an online banking account activated for participation in paydirekt, be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us.
Immediately after the order, we request paydirekt to initiate the payment transaction. The payment transaction is automatically carried out by paydirekt. Further information can be found during the ordering process. 

Amazon Pay
During the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. To process the order and pay the invoice amount via Amazon, you must be registered there or register first and legitimize yourself with your access data. There you can select the delivery address and payment method stored with Amazon, confirm the use of your data by Amazon, and the payment instruction to us. Afterwards, you will be redirected to our online shop, where you can complete the ordering process. 
Immediately after the order, we request Amazon to initiate the payment transaction. The payment transaction is automatically carried out by Amazon. Further information can be found during the ordering process. 

Skrill
After submitting your order, you will be redirected to the website of the online provider Skrill. To pay the invoice amount via Skrill, you must be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us. Further information can be found during the ordering process. The payment transaction will be carried out immediately thereafter by Skrill.

Purchase on Invoice and Financing via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you purchase on invoice and installment purchase as payment options.
Please note that Klarna Invoice and Klarna Installment Purchase are only available to consumers and that payment must be made to Klarna.

Klarna Installment Purchase
With Klarna's financing service, you can flexibly pay for your purchase in monthly installments of at least 1/24 of the total amount (but at least €6.95). Klarna Invoice

Purchase on Invoice via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you purchase on invoice as a payment option. 
Please note that Klarna Invoice is only available to consumers and that payment must be made to Klarna. 
When purchasing on account with Klarna, you always receive the goods first and always have a payment period of 14 days.

SEPA Direct Debit Plus
If you have chosen the SEPA Direct Debit Plus payment method from the online provider Paymorrow, you do not need to be registered there to pay the invoice amount. After a successful address and credit check within the order process, you grant the online provider Paymorrow a SEPA direct debit mandate upon placing your order, and we assign our claim to Paymorrow. Paymorrow will inform you of the date of the account debit (so-called pre-notification). By submitting the direct debit mandate, Paymorrow requests your bank to initiate the payment transaction. The payment transaction is automatically carried out and your account is debited. The account debit takes place after the expiry of the withdrawal period, i.e., after return processing. For payment processing via Paymorrow, the GTC of Paymorrow apply in addition to our GTC. Further details on the payment method can be found here.

Purchase on Invoice via Paymorrow 
To pay the invoice amount via the online provider Paymorrow, you do not need to be registered there. After a successful address and credit check during the order process, we assign our claim to Paymorrow. In this case, you can only make payment to Paymorrow with debt-discharging effect. Purchase on Invoice via BillPay
To pay the invoice amount via the online provider BillPay, you do not need to be registered there. After a successful address and credit check during the order process and placing the order, we assign our claim to BillPay. In this case, you can only make payment to BillPay with debt-discharging effect. For payment processing via BillPay, the GTC and data protection declaration of BillPay apply in addition to our GTC. Invoice
You pay the invoice amount by bank transfer to our bank account after receiving the goods and the invoice. We reserve the right to offer purchase on account only after a successful credit check.

Cash payment upon pickup
You pay the invoice amount in cash upon pickup.

  1. Retention of Title

The goods remain our property until full payment.
For entrepreneurs, the following additionally applies: We reserve ownership of the goods until all claims from a current business relationship have been paid in full. You may resell the reserved goods in the ordinary course of business; you hereby assign to us in advance all claims arising from this resale – regardless of any connection or mixing of the reserved goods with a new item – to the amount of the invoice, and we accept this assignment. You remain authorized to collect the claims, but we may also collect the claims ourselves if you fail to meet your payment obligations.

  1. Transport Damage

For consumers:
If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

For entrepreneurs:
The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the forwarder, carrier or other person or institution designated to carry out the shipment. Among merchants, the duty to inspect and give notice of defects regulated in § 377 HGB applies. If you fail to give notice as regulated therein, the goods shall be deemed approved, unless the defect was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.

  1. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
When used goods are purchased by consumers, the following applies: if the defect occurs after one year from the delivery of the goods, claims for defects are excluded. Defects that occur within one year of the delivery of the goods can be asserted within the statutory limitation period of two years from the delivery of the goods.
For entrepreneurs, the limitation period for claims for defects in newly manufactured items is one year from the transfer of risk. The sale of used goods is made without any warranty. The statutory limitation periods for the right of recourse according to § 445a BGB remain unaffected.
Towards entrepreneurs, only our own statements and the manufacturer's product descriptions that have been included in the contract are considered an agreement on the quality of the goods; we assume no liability for public statements by the manufacturer or other advertising statements.
If the delivered item is defective, we shall, at our discretion, initially provide a warranty to entrepreneurs by remedying the defect (repair) or by delivering a defect-free item (replacement delivery).
The above limitations and reductions in deadlines do not apply to claims for damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, limb or health
  • in case of intentional or grossly negligent breach of duty as well as malice
  • in case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the scope of a guarantee promise, if agreed
  • insofar as the scope of application of the Product Liability Act is open.

  1. Liability

We shall be liable without limitation for claims arising from damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, body or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of guarantee promises, if agreed, or
  • insofar as the scope of the Product Liability Act is applicable.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives or vicarious agents, our liability shall be limited to the amount of the foreseeable damage at the time of the conclusion of the contract, which must typically be expected to occur. Otherwise, claims for damages are excluded.

  1. Dispute Resolution
    The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/.
    We are not obliged and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.
  2. Final Provisions

If you are an entrepreneur, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, our registered office shall be the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you.
